An under trial will miss his exam papers scheduled to be held for 5th of this month after an NIA court deferred his application submitted through his Counsel till December 9.
Suhaib Bin Shafi (19), a resident of Kawdara Srinagar was arrested by police from Budgam on charges of being close to militants in 2018. Accordingly, an FIR vide number 111/2018 under section 302, 307 RPC and 18,19 ULP Act was registered against him.
The accused is the class 1st year student and was supposed to appear in the examination which is scheduled from December 5 this month. The examination will culminate on December 19.
Family sources said that the accused is presently lodged at District Jail Kathua.
His Counsel Advocate Javaid Hubbi on Monday filed an application before court that accused be allowed to sit in the examination but the court deferred the application till 9th of this month.
Advocate Javaid Hubbi said that application has been listed but deferred till December 9 while the fact of the matter is that accused has to appear in the examination from 5th of this month.
“There are so many cases of such nature. The careers of students lodged in jails have ruined at a time when Right to Education is a fundamental Right,” said a lawyer (KNT)
