Strengthening of Cultural Institutions

Culture and Languages is concerned, it was  constituted under Section 124 of erstwhile Constitution of Jammu & Kashmir in terms of SRO 340 dated 14.08.1963 being an autonomous Corporate body to foster and Coordinate activities in the spheres of letters and languages, visual and plastic arts, music, dance and drama, and of Culture generally in the State of Jammu & Kashmir, and to promote through them all the cultural unity of the State, and of the State with the other States of the Country

Culture consists of the beliefs, behaviors, objects, and other characteristics common to the members of a particular group or society. Through culture, people and groups define themselves, conform to society's shared values, and contribute to society. Thus, culture includes many societal aspects: language, customs, values, norms, mores, rules, tools, technologies, products, organizations, and institutions.
The State of  J&K is known for its Cultural diversities since Centuries and decades having different Cultural and societal religions and languages with high ethical values and brotherhood which would not only gives message of Love and Peace to the souls within the State and nation but all over the World. The J&K is known for its Saints & Sufis Reshis & Munies. In Order to continue the legacy of these cultural diversities various Government and Non-Government Organizations were working in the State like Radio Kashmir Srinagar and Jammu, Door Darshan Kendrea Srinagar and Jamm, besides J&K Academy of Art, Cultural and Languages, Radio Kashmir and Door Darshan were working under the Union Government , but J&K Academy of Art, Cultural & Languages was working under the State Government. The writers, Producers and Artists associated with these organization does not only earn their livelihood in these institutions, but plays an vital role for the Society to have a Nation of Peace, integrity, honesty with enthusiasm. But through a passage of time and especially during turmoil in the erstwhile State of J&K, these institutions have been affected to the large extent, as  not only due to the prevailing circumstances, but due to un-realistic approach and policy of either Central Government or State government, The long pending demand for Establishment of Film Industry and Cultural University or Tehzeeb Mahal in J&K have  also put on black burner. The Producers, Writers and Artists associated with these Organizations who were respectable, proudful and guiding personality for our society are striving pillar to post nowadays for their livelihood as they have become jobless in view of the policies of such institutions in the State particularly after UT of J&K.  
As for as Jammu & Kashmir Academy of Art,
Culture and Languages is concerned, it was  constituted under Section 124 of erstwhile Constitution of Jammu & Kashmir in terms of SRO 340 dated 14.08.1963 being an autonomous Corporate body to foster and Coordinate activities in the spheres of letters and languages, visual and plastic arts, music, dance and drama, and of Culture generally in the State of Jammu & Kashmir, and to promote through them all the cultural unity of the State, and of the State with the other States of the Country. The Hon’ble Governor was Patron,   Chief Minister as President and Secretary was Principal Executive Officer of the Academy. Besides other Committees, the Central Committee interalia had to exercise the executive authority of the Academy in all matters of Finance, administration and organization subject to policy directives of the General Council and to create such posts as it may consider necessary for carrying on the work of the Academy and to prescribe the terms and conditions of appointment of these posts. The Secretary has been exercising all the powers, administrative and financial for the Academy as are vested in Major Head of Department of the Jammu and Kashmir Government. After abrogation of  Article 370 the erstwhile State of Jammu & Kashmir was divided into two Union Territories viz. Union Territory of Jammu & Kashmir and Union Territory of Ladakh, with the result legal uncertainty was created in the Academy, as a result of which the Academy has been registered as a Society under Societies Act. 1867 in Supersession of SRO 340 dated  14.08.1963 and updated Revised Rules & Regulations was issued for the Academy by the Department of Culture with the prior Approval of the Administrative Council vide Decision No. 10.03.2021 dated: 28.05.2021 in terms of Government Order No. 23 JK(Cul) of 2021 dated: 28.05.2022.
As per the revised rules of the J&K Academy of Art, Culture & Languages (Society) issued vide Government Order No, 23 JK (Cul) of 2021 dated 28.05.2022, the Secretary of the Academy (Society) mentioned as under:-
The Secretary shall be the Principal Executive officer of the Society and he shall be appointed by the President on such terms & conditions as the Committee may from time to time determine.
Provided that the President may appoint any UT Civil Service Officer as Secretary of the Society till such time a regular Secretary is appointed by him as per the procedure laid down in sub-rule (1) above.
The Secretary shall be the Ex. Officio Secretary and Member Secretary of the General Council, Central Committee and the Finance Committee and  unless otherwise specified,  he shall be the Chairman of the other  committees or such Committees which may be set up by the General Council or the Central Committee,  as the case may be.
Tenure of appointment.  The tenure of appointment of the Secretary shall be for a period of five years extendable by one year in case of outstanding performance.  
In view of the above rule position after declaring the J&K Academy of Art, Culture & Languages as society, the regular Secretary of the Academy (now Society) shall be made as per the terms and Conditions to be determined by the Committee for a period of five years extendable by one year in case of outstanding Performance. However, President of the Society (Hon/ble Lieutenant Governor) is within its powers to appoint any UT level Civil Service Officer as Secretary of the Society on temporary basis till regular Secretary shall be appointed strictly on the terms and conditions to be determined by the Committee.
Pertinent to mention here that prior to August, 2019 and prior to 2022 when J&K Academy of Art Culture & Languages was an autonomous institution, the Government has been appointed as Secretary for the Academy by constituted a search Committee for the purpose and one of such Committee has been challenged by a Senior Functionary of the Academy namely Dr. Amn Additional Secretary for finalizing of qualification and criteria for the post of Secretary, J&K Academy of Art Culture & languages in a writ Petition filed by him in the Hon’ble High Court which writ petition had been attained finality by upholding the Judgement of Division Bench of the Hon’ble High Court by the Hon’ble Supreme Court of India with the result a committee was constituted by the Department of Culture in the year 2021 under the chairmanship of Administrative Secretary Culture  for finalizing the qualification and criteria for the Post of Secretary, J&K Academy of Art, Culture & Languages. The Government in Culture Department or General Administration Department has been filling up of the post of Secretary, J&K Academy of Art, Culture & Languages prior to 2022 and after declaration it as Society from JKAS Cadre, thus does mot suffice the purpose of appointment of a Secretary for this vital Sect of the Culture which otherwise requires technocrat having good Cultural background and experience in the field of Art, Culture & languages as per its Constitution instead of KAS Officer.
In view of the above  backdrop, it could not be expected for promotion and development for preserving old  Cultural  and traditional ethics of our diversities, saint & Sufis, Reshis & Munies in this UT of J&K till a regular Secretary for the Academy is appointed by the Government strictly as per its Constitution from Cultural background and experience in the field instead from administrative cadre  of the Government. However, Accounts Officers, Administrative Officers, Under Secretaries, Deputy Secretaries and Additional Secretaries in the Academy (Society) can be taken and posted from Administrative Cadre from GAD/Finance Department  to assist the Secretary to carry  official work of the Academy.
It is reiterated that such Cultural Institutions has not been strengthened in the UT of J&K as per its requirement by taking all concerned Stakeholders on board to finalize proper strategy and action plan for its promotion & development in real perspective, Pertinent to mention that organization of J&K Academy of Art,  Culture and Languages has not been extended upto the District Level for the last more than 60 years and even no  Cultural Centre at District Level has been established on the similarly  established in the twin Cities of Srinagar and Jammu like Tagore Hall and Abhinav Theatre at Srinagar and Jammu respectively to  develop and promote   linguistic and Cultural diversities  of  various areas  in all the Districts in the UT of J&K.  
In the Last, I appeal Hon’ble Lieutenant Governor, J&K (President of the Academy, Hon’ble Chief Minister of J&K, Honest and Competent Worthy Chief Secretary, J&K and  Principal Secretary to Hon’ble Lieutenant Governor, J&K  to take a personal keen attention towards this vital essence of our Society in order to preserve our traditional Cultural & linguistic by   building   a civilized society for future younger generation as a Nation in the UT of J&K by ordering of taking following measures in this endeavour :-
The qualification and Criteria for the post of Secretary, J&K Academy of Art, Culture 7 Languages may be finalized at an earliest and the post of Secretary may be filled up immediately from the stakeholders and having background and experience in the field of  Art,  Culture and Linguistic. However, Posts of Administrative  Officers, Accounts Officers, Under Secretaries, Deputy Secretaries and Additional Secretaries in the Academy (Society) can be taken from the Government in General Administration Department/Finance Department.
Necessary directions may be issued for registering all Writers & Artists belongs to UT of J&K in the Academy (Society)  and exploring the possibility to fix their honorarium to utilize their services as and when required for carrying out the Schemes and Programmes of the Academy (Society) as per Constitution within and outside the UT of J&K.
A High Level Advisory Committee may be constituted comprising of all Cultural, Art and Linguistic Stakeholders in the UT of J&K for finalizing State Culture Policy for J&K and   Future  Action Plan for all wings of Culture Department including J&K Academy of Art, Culture & Languages, Archives, Archaeology & Museum. Library Department, Door Darshen. Kendra, Srinagar/Jammu and Radio Kashmir/Jammu.
A Unit or Campus of Film Industry in the UT of J&K may be established so that National and International artists and writers will get opportunity here to make Serials, Drama and Films and local artists and writers along with other relevant workers may also be involved for the purpose.  It will not only boost the Economy and Tourism in the UT of J&K but will get job opportunity and livelihood to the people associated with this field.
J&K Academy of Art, Culture & Languages may be declared as a Government Department as Directorate of Art, Culture & Languages instead of Society or Directorate General of Culture J&K (which includes all wings after merger of J&K Academy of Art, Culture & Languages, Directorate of Archives, Archaeology  & Museum, J&K  and Directorate of Library, J&K) for its broader development and promotion at gross root level.
Director Door Darshan Kendra (Kashir Channel) at Srinagar and Director Door Darshan Kendra (Dogri  Dugger Channel) be strengthened at par with Central Level by finalizing approval and Comissiong of Programmes at UT level at Srinagar and Jammu branch so as to involve local artists, writers and Producers etc. for the purpose in order to earn their livelihood.
The name of Department of Culture may be changed in  the UT of J&K  as Department of Cloture, Heritage and Linguistic.
The wings of Institute of Music and Fine Arts may be transferred back from University of Kashmir/Jammu to J&K Academy of Art, Culture and Languages.
