J&K’s Governance Landscape: Emerging Challenges for the New Regime- I

J&K assembly elections, after a gap of almost seven years, may have ended a period of disquiet for the politicians in Jammu and Kashmir but the year 2025 brings the challenge of navigating dual control in a J&K Union Territory where Raj Bhavan still holds sway and influence over the chief minister's office in the absence of transaction of business rules and the promised statehood. For the first time since independence the assembly elections in Jammu and Kashmir were held this time in a completely surcharged and changed atmosphere. The vote was mainly in favour or against the central government’s decisions on August 5, 2019 and poor out reach of the establishment to fulfill daily requirements and aspirations. The polling was mainly a response to what happened to the erstwhile state of Jammu and Kashmir on that day. The decisions had led to bifurcation of the J&K state into two union territories and abrogation of Article 370 and Article 35-A. Several changes were also made through series of orders since then. Major Kashmir based political stakeholders, National Conference, congress, and PDP joined the electoral fray fiercely opposing BJP’s or the central government’s decisions and seeking votes for their “struggle to get back the special status and statehood”. They were making promises despite fully knowing that “hands of the clock” were never overturned as far as the restoration of special status to Jammu and Kashmir is concerned. BJP sought votes for abrogating the Article 370 and “ending an era of separatism and terrorism and starting a fresh atmosphere of peace and development.” Congress took a middle path. After forming a pre- poll alliance with NC, the party promised to work for the restoration of statehood and skipped touching the sensitive special status related issue. All the parties also promised solving the day-to-day problems and other related issues of the common masses if voted to power. The fringe parties where more or less aligned to the stand taken by their partners. After the completion of polling result on October 8 surprisingly saw thumping majority going to NC and its partners depicting a convincing a vote despite BJP’s rigorous campaign.
Whatever was the verdict, it has to be respected at all levels and by all stakeholders. This is very important for the survival of democracy in Jammu and Kashmir and long lasting peace. People by and large again showed enormous faith in democracy. If utilized by concerned quarters with sincerity and appropriately, the trust re-imposed can lead to movement forward for the betterment of the people of Jammu and Kashmir. Free and fair elections continue to be the essence of Indian democracy. This essence needs to be safeguarded to avoid any damage to soul of democracy which has proved disastrous in Jammu and Kashmir in past.

This conflict between the governor’s power and the autonomy of the elected government creates an atmosphere of governance instability, which, in turn, contributes to growing disenchantment among citizens.

Lost Statehood


Another significant challenge faced by the new government is the loss of statehood following the revocation of Article 370 in 2019. The reorganization of Jammu and Kashmir into a Union Territory (UT) dramatically altered the political landscape of the region. With the loss of statehood, the region’s political autonomy was diminished, and the NC, a party that has traditionally championed the cause of regional self-governance, found itself grappling with this loss of power. The transition from statehood to a Union Territory meant that decisions regarding the region’s governance now rested in the hands of the central government, with limited involvement from the local legislative assembly. The NC’s struggle to regain statehood is not just a political issue but also an emotional one, as it touches on the identity and aspirations of the people of Jammu and Kashmir. The loss of statehood has reduced the NC's ability to push for local development policies, implement socio-economic programs, and secure funding for key infrastructure projects. This dramatic shift has created an atmosphere of political alienation, with many citizens feeling disconnected from the central government and its policies. As the new government continues to fight for the restoration of statehood, it must also contend with the growing frustration of the people who have witnessed a loss of political agency.

Executive Duality and Ambiguities

 

The duality in executive powers represents another challenge in the governance of Jammu and Kashmir. The reorganization of the region into a Union Territory has introduced a situation where the executive powers are split between the local lieutenant governor and the elected representatives of the NC-led government which has generated ambiguities in functioning. This dual structure complicates decision-making, leading to inefficiencies, delays, and sometimes outright conflict. While the lieutenant governor is appointed by the central government and has substantial authority, especially in matters of law and order, the NC government, though democratically elected, finds its powers limited in areas that were once within its purview. The result is a duality that leaves citizens confused about who holds ultimate authority over local matters. For instance, the lieutenant governor may override decisions made by the local government, and central government policies are often implemented without the full consent or consultation of the local leadership.This creates a governance vacuum, where neither the people nor the elected representatives feel entirely in control. Furthermore, this duality in executive powers weakens the ability of the NC government to effectively address the local needs of its citizens, resulting in a governance system that is both fragmented and inefficient.

Reservation discontent and Division

The reservation bias is a turning as a burning issue with every passing day. Non-beneficiary groups i.e. general category is resentful and dismayed, feel alienated and victimized by unjustified reservation because due to this policy they are confronted with similar socioeconomic hardships. The exaggerated importance to reservation policy is generating deep rooted social polarization. Large section of population is feeling exclusion in the process, if it flares up, can assume serious propositions in the form of resistance against the policy and dispensation. The Unraveling of reservation bias has all potentials to act as consequence for social backlash, a catalyst for social polarization and resentment and may result into deepening socio-economic divide. It has also potentials to grow rift in society, disturb harmony, polarize it and create disorder. It is in the interest of the J&K stability and development to foresee and sort out reservation dilemma and controversies at an earliest to tread smoothly the path of development and prosperity.


The People’s Pulse

The mood of the people in Jammu and Kashmir is another critical factor that the NC government must contend with. Over the years, the people of the region have experienced significant political upheaval, social disruption, and a shift in their political landscape. The revocation of Article 370, a move seen by many as a direct assault on the region’s autonomy, led to widespread disillusionment. This mood of discontent has translated into a general sense of alienation from the central government and its policies. The NC, historically a party that championed the cause of self-rule, now finds itself in a difficult position. On one hand, it is fighting for the restoration of statehood and greater autonomy, while on the other hand, it has to manage growing public frustration. This creates a political climate where public opinion is volatile, and any misstep could lead to further erosion of support. Moreover, the security situation in the region has not improved significantly, contributing to a mood of fear and uncertainty among the population. These sentiments are often reflected in the political discourse, making it challenging for the NC to present itself as the solution to these complex issues.

Burden of Promises


The National Conference government, like any political entity, faces the challenge of managing the expectations of voters. In the context of Jammu and Kashmir, these expectations are often heightened by the promises made during election campaigns and the growing demands for development, security, and autonomy. However, the reality of governance, particularly in a Union Territory with limited powers, makes it difficult to fulfill these expectations. Voters in Jammu and Kashmir have long sought political stability, economic development, and improved quality of life. The NC government is under pressure to deliver on these fronts, but the political landscape, particularly with the central government's heavy involvement, makes it difficult to effect meaningful change. The government must navigate these expectations while simultaneously addressing the broader issues of governance, security, and political identity.As voter expectations rise, so too does the risk of disappointment. The NC government must walk a fine line between managing its promises and making realistic commitments to the electorate. Failure to meet these expectations could lead to a loss of trust, eroding the party’s political capital.

Finally, the loosening of the NC’s historical legacy of governance poses a significant challenge. The party has been a dominant force in Jammu and Kashmir for decades, but its historical connection to the people and its role as a regional political leader are being eroded. This makes it more difficult for the party to reconnect with the people and assert itself as a viable political force. The weakening of the NC's legacy also means that it faces increasing competition from other political parties, including those with stronger ties to the central government. The NC is struggling to redefine its role in a transformed political environment, where its traditional stance on self-rule is no longer as politically relevant as it once was. As the politicians attempt to preserve their legacy, new government must also contend with a new generation of voters who may not have the same historical attachment to the party. The challenge, therefore, is to reinvigorate the party’s appeal by adapting to contemporary issues while retaining its traditional political values.
In conclusion, the new government faces a range of significant challenges in navigating the complex political and governance landscape of Jammu and Kashmir. From interference by the governor to the loss of statehood, the duality in executive powers, shifting public sentiment, heightened voter expectations, and the erosion of its historical legacy, the new must find ways to adapt and respond to these issues.
