Judicial Academy holds special training on CPC in Srinagar

Under the patronage of Chief Justice Arun Kumar Pali (Patron-in-Chief, J&K Judicial Academy), the J&K Judicial Academy on Friday organised a One-Day Special Training Programme on the Code of Civil Procedure (CPC) and the Commercial Courts Act at Mominabad, Srinagar. The training was held for Judicial Officers from the District Judiciary of Kashmir Province and the Union Territory of Ladakh.

Director of the Academy, Sonia Gupta, delivered the opening remarks, outlining the scope and objectives of the Commercial Courts Act, 2015. She highlighted how the Act has introduced key reforms like pre-institution mediation, case management, and streamlined procedures aimed at ensuring faster adjudication of high-value commercial disputes.
Session I was conducted by Faisal Qadri, Senior Advocate, High Court of J&K and Ladakh. He traced the legislative background of the Commercial Courts Act and its role in bridging gaps left by the traditional CPC framework. He discussed the importance of specialized courts, reduced litigation timelines, and cost-effective dispute resolution. Qadri also pointed to challenges such as jurisdictional ambiguities and the need for judicial upskilling in complex commercial matters.
Session II was led by Z.A. Shah, Senior Advocate, who reflected on the evolution of commercial jurisprudence in India. He emphasized the need for purposive interpretation of laws, judicial integrity, and adaptability to societal and technological changes. Shah called for greater uniformity in procedural application and reiterated the vital role of mediation in resolving disputes efficiently.
The programme concluded with an interactive Q&A, where judicial officers discussed practical challenges and implementation gaps in commercial adjudication. Participants agreed on the need for ongoing training and institutional clarity to enhance the effectiveness of commercial courts.
The event marked another step in the Judicial Academy’s mission to equip the judiciary with the knowledge and tools necessary for handling complex and specialized legal matters with competence and efficiency.
