Rethinking Reservation: A Call for Merit-Based Equality

As all of you aware about the Policy of various Nations in the World with regard to appointment of workforce in public or private sector for their Nation.

A society of a nation comprises people from various walks of life, including doctors, engineers, advocates, judges, farmers, scientists, agriculturists, teachers, and others. The policies of a particular state or country play a crucial role in shaping these individuals into a strong, vibrant, intelligent, and competent society. Therefore, it is essential that the policies of the concerned state or nation aim to cultivate a brilliant, dedicated, and skilled workforce across all sectors, public and private, such as healthcare, engineering, education, science, leadership, and agriculture. No compromise should be made in the formulation or implementation of such policies, as doing so would undermine the very objective of building a strong and resilient nation.

As all of you aware about the Policy of various Nations in the World with regard to appointment of workforce in public or private sector for their Nation. If we talk about the Policies of our Country or State/UT of Jammu & Kashmir, there seems to have a transparent, democratic and dignified Policy,, but with un-realistic and un-justified share for un-justified people declared by giving benefits under reservation quota by compromising the very purpose of building a strong Nation of brilliant and Intelligent workforce despite of the fact that while analysing the reservation either in appointment or promotion with reference to the constitution, it has been observed that the reservation practice has been discouraged by our Constitution as it stressed the need for equal opportunity for all citizens in matters of employment and appointment to public Service. Besides, the Supreme Court in its recent judgement has reiterated that promotion is not a fundamental right for government servants in India, as the Constitution does not prescribe any criteria for filling promotional posts. This has been left to the discretion of the legislature and executive.
It is evident that under open and General category, Brilliant and intelligent candidates gets job opportunities in our Country, but at the same time, lions share has been kept under different reserved categories which has not only discourage the morale of intelligent and efficient candidates but also making the Society of inefficient doctors, teachers, leaders, engineers etc. for the Nation. The implementing agencies for issuance of relevant eligible reserved category certificates under the policy are not fairly issuing such certificate in absence of clear cut policy within the reasonable and justified frame work and the candidates whosoever gets such certificates shall have to compromise by the people of the society to engage them on appointment by direct recruitment or promotion.
Therefore, it is crystal clear that reservation policy is a policy which not only gets the share of meritorious candidates either in direct recruitment. Promotion or any Professional Courses, but also giving us inefficient, doctors, engineers, lawyers, Scientists. Agricultrists etc. for the society. Besides in-efficient officers, doctors Engineers etc, shall have to get promotion earlier than competent efficient, intelligent & brilliant and experienced officers doctors and Engineers etc and have to become their senior officers and has to work under them which is not only feels humiliation for such senior, experienced and brilliant officers, but also ultimately failure of the system of that particular organization under these circumstances.
No doubt Our society in the State/UT or Nation comprising number of people belonging to various categories from Scheduled Caste, Scheduled tribe, social Caste, Backward Classes etc. but the Government shall encourage and take concrete steps by making such Policy to uplift them in such a way that they will compete with the people from General Category. By keeping them under reservation quota in appointment and promotion, the Government in one hand keep them still under below the Upper Class as discrimination to these categories which is against the Constitutional guarantee for equal opportunities for every citizens and other hand, the Government not taking right steps in order to boost them in respect of educational facilities, enhancement of infrastructure in backward areas in order to build them to compete with General Category People in every spheres of life including appointment or Promotion. Therefore, discouraging the practise of reservation shall have benefit to the reserved category people as the society shall treat them equally and bitterly, and subsequently treat them as General Catagorey People as well. When there would be no reservation, all such people could not called as Scheduled Caste, Scheduled Tribe, Social Caste, Backward Area etc. but all people shall be called and treated General Category People, as such, by doing so practically discrimination with these Categories shall put to end once for all.
In view of the above, I appeal the Union Government and State Government of Jammu & Kashmir to come forward by involving all stakeholders including intellectuals, Senior citizens, Lawyers, doctors, Teachers etc, to above the politics and explore the possibility to discourage the reservation policy for appointment, promotion etc, and push to prepare substitute policy for promotion and development of all such categories of people so as to make them equal in every spheres of life like Increasing living standards, educational & Professional qualification, besides to develop all backward area in respect of infrastructure in order to compete and treat them with respect & honour with the People of General Category to make a strong efficient and intelligent society for our Nation.
