
The President's rule in Jammu and Kashmir has been revoked on Sunday evening, paving way for formation for government in the Union Territory.
A notification issued by President of India Droupadi Murmu reads: “In exercise of the powers conferred by section 73 of the Jammu and Kashmir Reorganisation Act, 2019 (34 of 2019) read with articles 239 and 239A of the Constitution of India, the order dated the 31st October, 2019 in relation to the Union Territory of Jammu and Kashmir shall stand revoked immediately before the appointment of the Chief Minister under section 54 of the Jammu and Kashmir Reorganisation Act, 2019”.
The President issued the revocation order after J&K Lt Governor Manoj Sinha recommended to central government to lift the President’s rule in the UT.
This comes after National Conference leader and CM designate Omar Abdullah met Lieutenant Governor Sinha on Friday evening to stake claim to form a new government following the recently concluded Assembly polls in J&K.
Omar was unanimously elected as leader of National Conference legislative party on Thursday, paving the way for his second term as chief minister.
Omar was backed by Congress, five independents, CPI (M) and lone AAP MLA.
President's rule was imposed in the region after the PDP-BJP alliance crumbled on June 19, 2018.
On August 5, 2019, the central government abrogated Article 370 and downgraded and bifurcated erstwhile J&K state into two Union Territories.
On October 31, 2019 when Jammu & Kashmir was converted into two Union Territories, Home Ministry had issued a presidential order under Section 73 of the Jammu and Kashmir Reorganisation Act, 2019 imposing President’s Rule in the Union territory of Jammu and Kashmir.
The proclamation President’s order needed to be revoked because it had suspended all the provisions of the Reorganisation Act dealing with J&K Assembly and the elected government.
The revocation of the President’s rule has paved way for the government formation in J&K.
It is expected that the swearing-in ceremony of Omar Abdullah led government can take place in next few days.
The NC won 42 seats in 90-member Jammu and Kashmir assembly while Congress secured just six. The two parties had formed a pre-poll alliance. Their position has been strengthened by the support of five independent MLAs and one from the Aam Aadmi Party (AAP). The Bharatiya Janata Party (BJP) emerged as the second-largest party with 29 seats.
The election, held in three phases on September 18, September 25, and October 1, was the first since Article 370 was revoked .
