HC cautions trial courts on judicial temper

Srinagar, April 25: The High Court of Jammu & Kashmir and Ladakh has reminded trial courts that propriety in judicial conduct and restraint in addressing members of the Bar is an essential part of judicial decorum, especially when senior advocates are appearing before the court in discharge of their professional duties.

The observation came while the court was dealing with a matter in which concerns were raised about the tone and manner adopted by a trial court while interacting with members of the Bar during proceedings.
The High Court emphasised that the dignity of judicial office is reflected not only in the correctness of decisions but also in the manner in which proceedings are conducted. It said that courts are expected to maintain a balanced, respectful, and measured approach while dealing with counsel, particularly those with long-standing experience and recognised standing at the Bar.
The bench observed that judicial temper must always remain under control and that courts are required to moderate their tone and tenor so that proceedings remain dignified and conducive to the administration of justice.
It further noted that the Bar and Bench share a relationship built on mutual respect, and any departure from this equilibrium can affect the overall functioning of the justice delivery system. The court stressed that senior advocates, by virtue of their experience and responsibility, assist the court in the effective adjudication of matters, and their role deserves due regard.
Reiterating established principles of judicial discipline, the High Court said that while courts are fully empowered to regulate proceedings and ensure discipline in the courtroom, such authority must be exercised with restraint and fairness. It cautioned that strong language or unnecessary harshness during proceedings can undermine confidence in the judicial process.
The court underlined that judicial officers are expected to act with patience, composure, and courtesy, even in situations where proceedings become contentious or complex. It said that maintaining calmness and respect in court proceedings is integral to upholding the dignity of the institution.
The observation was made in the context of reinforcing broader principles governing courtroom conduct and ensuring that the justice delivery system remains respectful, balanced, and fair to all stakeholders.
With this reminder, the High Court has once again highlighted the importance of maintaining judicial decorum and ensuring that courtroom interactions reflect the values of fairness, dignity, and mutual respect between the Bench and the Bar.
