‘Tainted’ police officer Davinder Singh dismissed

“Govt dumps key go-between of parliament attack case by invoking Article 311”

The J&K administration on Thursday dismissed the tainted police officer Davinder Singh from service by invoking the Article 311.
Singh, a Deputy Superintendent of Police (Under Suspension) S/o Mr. Deedar Singh R/o Overigund Tral, Pulwama was dismissed in terms of sub-clause(c) of the proviso to clause (2) of Article 311 of the Constitution of India, a GAD order No.451-JK(GAD) of 2021 Dated:20.05.2021, said.
“Whereas the Lieutenant Governor is satisfied after considering the facts and circumstances of the case and on the basis of information available that the activities of Mr. Davinder Singh, Deputy Superintendent of Police (Under Suspension) S/o Mr. Deedar Singh R/o Overigund Tral, Pulwama are such as to warrant his dismissal from service,” the order signed by LG Manoj Sinha said.
“And whereas the Lieutenant Governor is satisfied under sub-clause (c) of the proviso to clause (2) of Article 311 of the Constitution of India that in the interest of the security of the State, it is not expedient to hold an enquiry in (his) case,” it said.
“Accordingly, the Lieutenant Governor hereby dismisses … Davinder Singh from service, with immediate effect,” it said.
Singh was caught on January 11 last year with two militants of the Hizb-ul-Mujahideen on the Srinagar-Jammu highway.
According to police, Naveed Babu, one of the two militants and the commander of Shopian district of Hizbul, and others were planning to execute terror attacks in Delhi and other parts of the country as well as carry out target killings of protected persons.
The police claimed to have recovered AK-47s and other arms from the car they were travelling in. A third person, labelled an ‘overground worker’ of the outfit.
Singh had reportedly told a Deputy Inspector General of Police, who was party of police team that arrested him, not to “spoil the game.”
Praising Singh, Kashmir’s inspector general of police Vijay Kumar had said Singh was part of several anti-militancy operations but the circumstances under which he was arrested is a heinous crime.
“We are treating him at par with the militants.”
Within 24 hours of the arrest the case was handed over by New Delhi to the National Investigation Agency (NIA).
The 2001 parliament attack convict Afzal Guru had reportedly said Singh had asked him to take him to Delhi where he ended up being one of the five suspects who helped a group of militants in staging a daring attack in parliament precincts on December 13, 2001, killing nine people before being gunned down.
In 2001, Singh was shunted out of Budgam after public protests against custodial deaths. In 2015, he and another DSP of the Special Operations Group (SOG) were named in an FIR for allegedly extorting money from common people and implicating them in false cases.
Singh was also awarded the Police Medal for Meritorious Service last year. Singh was granted bail by a Delhi court in another terror-related case filed by the Special Cell of the Delhi Police last year along with another accused Irfan Shafi Mir. The court noted that the probe agency had failed to file a chargesheet within 90 days from his arrest, as prescribed under law.
