Srinagar, Oct 22: The Jammu and Kashmir Government has directed all administrative departments and concerned authorities to ensure the timely submission of replies, affidavits and compliance reports in pending court cases, particularly contempt petitions, warning that delays may lead to accountability being fixed on the officers responsible.
The directions have been issued by the Department of Law, Justice and Parliamentary Affairs to strengthen the government’s representation before courts and tribunals and ensure compliance with judicial orders within the stipulated time.
Administrative departments, heads of departments and other concerned authorities have been instructed to provide complete records, relevant documents and necessary factual information to the concerned Law Officer and Officer In-charge Litigation well in advance. The move is aimed at facilitating the preparation and timely filing of replies and affidavits before the respective courts.
In cases where judicial directions require implementation, the concerned authorities must submit updated compliance reports along with supporting documentary evidence to the Law Officer and Officer In-charge Litigation before the scheduled hearing.
The government has also stressed the need for effective coordination among the Officer In-charge Litigation, the concerned administrative department and the Law Officer to ensure that all replies, affidavits and compliance reports are submitted within the prescribed deadlines.
Taking a serious view of potential lapses, the government has warned that failure to provide the required records, instructions or compliance reports could result in the non-filing of replies or affidavits and may lead to adverse judicial orders. Such instances will be examined seriously, and responsibility will be fixed on the officers concerned under the applicable rules.
The instructions have been circulated to the Advocate General of Jammu and Kashmir, Administrative Secretaries, the Registrar of the Central Administrative Tribunal’s Jammu and Srinagar Benches, Divisional Commissioners, government counsel, Deputy Commissioners, Superintendents of Police and the Director of Litigation, among other concerned authorities.
